       The draft order of the Deputy Prime Minister - Minister of Finance of the Republic of Kazakhstan «On determining the specifics of customs declaration, category of goods, region of implementation of the experiment in the field of foreign electronic commerce conducted in the Republic of Kazakhstan and the application of the notification procedure for compliance with technical regulations in respect of electronic commerce goods» (hereinafter – «On determining the specifics») was developed in compliance with the Order Prime Minister of the Republic of Kazakhstan No. 90-r dated 01.06.2023, as part of ongoing decentralization activities.

       At the same time, the adoption of this regulatory legal act is conditioned by the Constitutional Law of the Republic of Kazakhstan dated April 19, 2023 «On Amendments and Additions to Some Constitutional Laws of the Republic of Kazakhstan on administrative reform in the Republic of Kazakhstan» and the Law of the Republic of Kazakhstan dated April 19, 2023 «On Amendments and Additions to Some Legislative Acts of the Republic Kazakhstan on administrative reform in the Republic of Kazakhstan».

      In connection with the amendments made by sub-paragraphs 14-1) and 14-2 to paragraph 2 of Article 2 of the Code of the Republic of Kazakhstan «On Customs Regulation in the Republic of Kazakhstan», the Ministry of Finance of the Republic of Kazakhstan was instructed to develop this draft order «On the definition of features».

      The purpose of the draft of this regulatory legal act is, within the framework of a pilot project (experiment) in the field of foreign electronic trade in goods conducted in the Republic of Kazakhstan, to determine the specifics of customs declaration, to identify categories of goods, to establish the region of implementation of the experiment, as well as the application of a notification procedure for compliance with technical regulations.
