The Order of the Deputy Prime Minister - Minister of Finance of the Republic of Kazakhstan No. 739 dated July 04, 2023 «On determining the specifics of customs declaration, category of goods, region of implementation of the experiment in the field of foreign electronic commerce conducted in the Republic of Kazakhstan and the application of the notification procedure for compliance with technical regulations for electronic commerce goods» (hereinafter – the Order) was developed in execution of the Order of the Prime Minister of the Republic of Kazakhstan No. 90-r dated 01.06.2023, within the framework of ongoing decentralization measures.

At the same time, the adoption of this regulatory legal act is conditioned by the Constitutional Law of the Republic of Kazakhstan dated April 19, 2023 "On Amendments and Additions to Some Constitutional Laws of the Republic of Kazakhstan on administrative reform in the Republic of Kazakhstan" and the Law of the Republic of Kazakhstan dated April 19, 2023 «On Amendments and Additions to Some Legislative Acts of the Republic Kazakhstan on administrative reform in the Republic of Kazakhstan».

In connection with the amendments made by sub-paragraphs 14-1) and 14-2 to paragraph 2 of Article 2 of the Code of the Republic of Kazakhstan "On Customs Regulation in the Republic of Kazakhstan", the Ministry of Finance of the Republic of Kazakhstan was instructed to develop this Order.

The purpose of this regulatory legal act is to determine the specifics of customs declaration, to identify categories of goods, to establish the region of implementation of the experiment, as well as the application of the notification procedure for compliance with technical regulations in the framework of a pilot project (experiment) in the field of foreign electronic trade in goods conducted in the Republic of Kazakhstan.

In addition, the draft of this order was posted for public discussion on the Internet portal «Open NPAs» on June 13, 2023 https://legalacts.egov.kz/arm/admin/viewcard?id=14606392. Also, the Order of the Deputy Prime Minister - Minister of Finance of the Republic of Kazakhstan dated Jule 04, 2023 No. 739 as a result of a legal examination in the judicial authorities passed state registration and was posted on the Unified platform of Internet resources of state bodies of the Republic of Kazakhstan on July 17, 2023.
