
The Committee's staff took part in the St. Petersburg International Anti-Crisis Congress «Parade Assembly», which was held on July 26-27, 2023 in the city of St. Petersburg, Russian Federation.
The event was also attended by representatives of the Export and Investment Promotion Agency under the Ministry of Economy of the Republic of Azerbaijan, the Department for Rehabilitation and Bankruptcy of the Ministry of Economy of the Republic of Belarus, the Supreme Economic Court of the Republic of Tajikistan.
The delegation from Kazakhstan consisted of the Deputy Head of the Department for Work with Debts and Insolvent Debtors of the Committee, Sisembayeva Meruert Kabdyrashitkyzy, the chief expert of the Department for Work with Debts and Insolvent Debtors of the Committee, Rakhmetova Ainara Boranbaevna, as well as administrators of the RPA «Union of Professional Managers in Bankruptcy Procedures «Zhetysu».
M.K. Sisembayeva made a welcoming speech at the plenary session on behalf of the management of the Committee, and also read a report on the topic «Institute of Bankruptcy in the Republic of Kazakhstan».
During the forum, problematic issues of bankruptcy were discussed such as: «Challenging the debtor's transactions and the manager's responsibility for not challenging transactions», «Creditor control over the course of the bankruptcy procedure», «Problems of the manager in the process of exercising his powers to collect information and documents about the debtor. Ways to solve them», «Percentage remuneration of the manager when bringing the debtor's official to subsidiary liability», «Recovery of losses from creditors of the debtor in bankruptcy», «Realization by the manager from the auction of the rights of claims for subsidiary liability in case of solidarity of debtors», «The main problems of paying taxes in bankruptcy proceedings, features of VAT taxation in bankruptcy proceedings», «The role of self-regulating organizations and National associations», «Problems of including hereditary property in the debtor's bankruptcy estate», «Tools for effective information interaction between participants in bankruptcy proceedings and with buyers of debtors' property», «Digital assets in bankruptcy», «Mediation functions of the Debt Restructuring Assistance Fund – a way to preserve business», «Mediation in bankruptcy challenges and opportunities», «Imaginary owners: how to return property to bankruptcy estate?», «On the inadmissibility of subordination of claims of affiliated creditors in bankruptcy cases of individuals.»
Following the results of the working visit, it is planned to consider the issue of amendments and additions to the current legislation in the field of rehabilitation and bankruptcy in terms of: determining the status of administrators, approving professional standards; developing the institute of self-regulation in the field of rehabilitation and bankruptcy; providing an opportunity for administrators to receive reimbursement of administrative expenses when bringing officials of the debtor to subsidiary responsibility.
